Changes to the Federal Rules of Appellate Procedure Effective December 1, 2013

The Federal Rules of Appellate Procedure were modified effective December 1, 2013.  The new version can be found here.  One change of immediate import affects the structure of the appellant's opening brief and the appellee's brief.  FRAP 28  no longer requires a separate "Statement of the Case" and a "Statement of the Facts."  The rule now in effect combines those two sections of the brief to be called simply "Statement of the Case," which is to set forth the following: "the facts relevant to the issues submitted for review, describing the relevant procedural history, and identifying the rulings presented for review, with appropriate references to the record (see Rule 28(e))."
